This was just brought to my attention, the link below is  to an ebay seller that is using  pictures drawn and colored by people on dA, and other places, to make a profit for themselves

unfortunately, DA content needs to be conspicuously water marked (faded colors out lining your mark), front and center.

You should just flat out file an infringement claim through their system and see about getting it done and over with (possible account banning).  A couple of years ago, I've seen a case where someone made this indy fan game called Beats of Rage (Streets of Rage clone with KOF characters) and someone tried selling it as a legit release.

update:  when I threatened to take up an intellectual property infringements report with eBay, he replaced my powergirl pic with another, likely also stolen one.  So I don't know what real good that has done, but if you just want to get your own work out of his store, you might be able to do it that way..

It doesn't look like eBay is very interested in looking at these cases, they make it very hard to contact them about anything that's not on a list of common issues.  I contacted the seller with this message:

Your Sexy Power Girl Magnet #69 contains an image that I drew, and I would like you to remove it from your listings. Since I never authorized the use of this image, if you do not remove it, I will take up an intellectual property infringements report with eBay. Thanks.

So I'll wait a few days and see if he takes it down.  It looks like all of their products use stolen images, so they really need to be shut down entirely, but short of actually calling eBay on the phone (and no doubt getting someone on the line who has no clue how to deal with this), I'm not really sure what to do.

Thanks for alerting me to this issue - I don't really have high hopes of resolving it satisfactorily, nor do I really feel like I'm personally being ripped off (I wasn't planning on selling anything with this image, so I've lost nothing by him selling it), even though I do agree that in principle it's theft of intellectual property.  Probably a slippery slope for me, since I mostly draw characters owned by others without obtaining any kind of licensing, so there's that.  Makes it hard to get upset about it.  But he's clearly using images straight from comics, in addition to fan-art, cosplay photos, etc, and that is clearly actionable, but if the owners of those 100% legit images don't serve a cease-and-desist order, probably nothing  is going to happen.  Well, maybe if enough of us contact eBay, they might shut him down.  Can't hurt to try, I suppose.

Just got off the phone with eBay and they are now opening an investigation on this eBay "seller".I saw the "items" for sale and recognized the art from some I watch here on DA.They may contact me again for further info so DO NOT delete this status update alright?I may need to refer it to them as part of the investigation.If you choose to get involved,note me and keep in contact with me till I know more from them.I didn't get a length of time it will take for them to look into it or what may happen as they keep what they will do if this person is found guilty.Part of their privacy code I suppose.But as I know more,I will let you know.However,this could take a lot longer than just a few days.So hang in there.They may wish to speak to at least one person who got their art stolen to verify the theft(s),so you may need to be brave enough to come forward to help them.I have their eBay page and this update saved in my web browser so I can find it again.So I can't stress enough not to delete this alright?Ttys Beau. :)

You got it dude. :nod: Glad you're not going to delete it.It may come in handy with their investigation.But like I mentioned,I have no idea how long this will take nor what they will do to this person.Are they on deviant art?If so,we need to get this person reported here too.But that will have to come from the victims of the thefts.Sadly those who didn't get anything stolen,can't do anything.But if you run across anyone else on eBay like this,let me know.I have an account on eBay as a buyer only.I definitely can let eBay know of things like this.

This actually happens at conventions where people peddle dvds and posters of others art.  Seen it, didn't support it.  Though there is a slight element that if your work was good enough to steal in the first place... then that's almost a good thing?  Still wouldn't want it to happen.  Nice to shine a light on it and stop it where & when you can.

No problem. Websites take action best when the original artists/owners of the work report to take them down mostly with take down notices.
